The Digital Millennium Copyright Act, or the DMCA, as we will refer to it, is legislation that protects individuals from non-consensual sharing of media on the internet. The DMCA gives individuals the power to request for websites and other platforms to remove their personal images, video, or other media. This process gives you the ability to re-establish your ownership over your personal content and erase it from platforms you do not consent to.

Here, we will be exploring in more detail how a DMCA takedown works, how to start the process, and how Loti can help you along the way.

What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a component of the U.S. Copyright Law that defends the rights of content creators and their ability to remove material from the internet if their copyrights have been infringed. It holds internet service providers (ISPs) accountable if copied content is found on a website they host and obligates them to remove content if a DMCA takedown request is filed.

What is a DMCA Takedown?

A DMCA takedown is a tool that can be used to remove your content from a website at the owners’ request. Through the DMCA framework, you can request the removal of an image, video, or other media from a website if it belongs to you and has been posted without your permission.

When non-consensual intimate images or videos have been taken or recorded by you, you own them and can use a DMCA takedown request to have it removed if it is uploaded to a site without your permission.

What If You Didn’t Take or Record the Content Yourself?

In instances where you did not capture or record the content yourself, you may need to purchase the copyright to the content before filing a DMCA takedown notice. You can do this by creating a copyright assignment agreement. This is essential so the DMCA can be enforced. To create one of these agreements, you must find a copyright attorney to help negotiate your content ownership.

What Do You Need to File a DMCA Takedown?

Once you have established that you have ownership over the content that was uploaded to the internet non-consensually, there are three things you’ll need to create a DMCA takedown notice:

  1. The Link to the Stolen Content
This is simply the URL of where the non-consensual photos or videos have been uploaded. It’s beneficial to have the URL to the site and the link directly to the image. To get the image link, right-click on the image and press “Copy Link Address.”

  1. The Source
If the content was originally uploaded to another site, you would list that URL here. This is where the uploader found your content and stole it from. For example, if you are a creator, it could be from your website or social media profile. If the content was stolen from your laptop, phone, or another device, you could also note that in this section.

  1. Proof of Ownership
Here, you need to provide your name and a detailed description of the content to prove ownership. For example, when the content was created, when it was stolen, how you created the content etc. You can also include the copyright assignment agreement if you have one.
