The Digital Millennium Copyright Act (DMCA) is a component of the U.S. Copyright Law that defends the rights of content creators and their ability to remove material from the internet if their copyrights have been infringed. It holds internet service providers (ISPs) accountable if copied content is found on a website they host and obligates them to remove content if a DMCA takedown request is filed.

What Do You Need to File a DMCA Takedown?

Once you have established that you have ownership over the content that was uploaded to the internet non-consensually, there are three things you’ll need to create a DMCA takedown notice:

  1. The Link to the Stolen Content
    This is simply the URL of where the non-consensual photos or videos have been uploaded. It’s beneficial to have the URL to the site and the link directly to the image. To get the image link, right-click on the image and press “Copy Link Address.”

  1. The Source
    If the content was originally uploaded to another site, you would list that URL here. This is where the uploader found your content and stole it from. For example, if you are a creator, it could be from your website or social media profile. If the content was stolen from your laptop, phone, or another device, you could also note that in this section.

  1. Proof of Ownership
    Here, you need to provide your name and a detailed description of the content to prove ownership. For example, when the content was created, when it was stolen, how you created the content etc. You can also include the copyright assignment agreement if you have one.
